مژده ناطقی Title of the 44th Main General Policies
With the announcement of the 44th Main General Policies of the Constitution in 2005 on privatization, on 08/11/1386, the Law on the Implementation of the General Policies of Article 44 of the Constitution was approved by the Islamic Consultative Assembly and was finally approved by the Expediency Discernment Council on 25/3/1387 and was notified to the government for implementation on 31/04/1387, which marked a step forward in the field of regulation. Chapter 9 of this law is related to the issue of facilitating competition and preventing monopoly, and in paragraph 53 of this chapter, the establishment of a council called the Competition Council is proposed. In this law, regulatory duties have been foreseen for the Competition Council.
Before the establishment of the Competition Council, the handling of anti-competitive procedures and the determination of disputes between natural and legal persons were carried out by the courts and the judiciary, and after the establishment of this council, judicial powers came into existence in an administrative institution. The Competition Council’s separation from the judiciary and its administrative nature have led to conflicts and interference between the Competition Council and the judiciary. This note will address one of the most important challenges between these two institutions, namely the enforcement of Competition Council rulings.
